So, What EXACTLY is Cash Gifting?
Before we go into our review about cash gifting, the 3 main reasons why most people choose to lean more about Cash Gifting activities is:
1. There is
no "company" behind a true cash gifting activity
In Cash Gifting, there are no "companies". It
is simply people, inviting others about their cash gifting club. A real gift is one that is given freely without coercion,
and with no expectation of any return or consideration within the
Gifting laws and rules set forth by legislation and consitutional
rights. In real cash gifting there is no solicitation allowed either, and that's where ALL online based gifting programs fail the "smell test".
Real cash gifting enables one person to gift another. No
middlemen. No companies. No fat cat sitting at the top deciding who,
when and how much people "get paid" as in other programs that have
to deal with the marketing of overpriced, low value "products &
services".
2. There are no products to promote. Cash
Gifting offers no products for sale. It's a very simple concept for people to
understand. Before I researched the rules and concept of Cash
Gifting, this honestly raised a red flag. I was so focused on
traditional "business" that I was making the mistake of trying to
think about Cash Gifting in the way I was taught to think of a
"business". But after researching, I found that Cash Gifting is NOT
a business, and is not portrayed as such. In fact, that is
one of the biggest challenges I see on the internet with online
based cash gifting programs.
There are so many people that get intrigued and join a cash
gifting program that may be properly structured, but then, they
revert to explaining it and treating it the way they do other more
traditional models of "home business" programs and that is a
problem. People get themselves into problems when they practice with
"motivated ignorance" in the marketplace of ideas.
You need to be sure you're learning Cash Gifting from people
that actually know what it is... and more importantly, from people
that also know what it is not. But since you have to solicit people to get to your site, cash gifting as a money making concept online just doesn't pass muster.
Cash Gifting...
By definition Cash Gifting (also referred to
as "Cash Leveraging") is the act of privately or publicly giving
another person or entity a declared sum of cash, strictly as a gift
and giving it freely without coercion or consideration. It is NOT a
"quid-pro-quo" transaction where you offer something of equal or
considerable value in exchange for cash. That would be NOT be
considered a true cash gift.
It doesn't involve network marketing, multi level marketing,
or a business or commercial activity. There are no business
transactions, investments and/or securities involved in a properly
structured cash gifting activity. It's strictly giving and
receiving real cash gifts.
There is no business or company or "location" and there are
no directors, officers, shareholders or principals. Individuals
simply support each other in the distribution of information and
communication regarding cash gifting and invite others privately to
learn about the concept.
It's certainly not for everyone, and it never will be.
Over
the years, there have been many opinions and thoughts as to the
legitimacy and morality of Cash Gifting as a viable and honest
means of generating cash. But at the heart of Cash Gifting is
a basic core principle that's often overlooked and
convoluted with greed and the lust for money.
Good people CAN get
together and do great things for others. And contrary to what some
extremists say, people have, do and will continue to give freely
without the expectation of receiving anything in return from
the person they give a gift to.
Other people
just choose not to believe that. The problem with cash gifting
programs on the internet is that it takes solicitation and that's where it has a legitimacy problem with most people (and Prosecutors).
The core principle is powerfully
simple...
"To help others first, in order to help yourself. To take
control of your own financial well being and not be so dependent on
other forces, traditions and systems that continue to fail
you."
There are countries where the act of gifting is actually the
highest or second highest portion of their economy, next to tourism.
It's just that most people fail to realize something is
so evident until we look outside our programmed
routines.
Is Cash Gifting
Legal?
Is it legal for consenting adults in a free society to CHOOSE
to send each other money?
Is it legal for you, after reading about the cash gifting
concept and knowing full well that you are sending cash to another
individual without expecting to get anything from him/her in return
for your cash gift... is it legal for you to send YOUR
property (cash) to someone else if YOU CHOOSE to do it of your own
free will?
The fact that people even ask this question these days tells
me a LOT about the current state of the world we live in today...
how "free" do people really believe they are? Or, put another
alarming way: How free to people actually want to be? Most people,
it can be argued, don't really want to be so free. They would rather
give up their true liberty in exchange for an institution
(government or corporation) to provide them a meager existence in
exchange for their submission and relative "security." Which in this
economy and in these troubled times, has been shown clearly to not
be as secure as people would like to think.
I like to ask
this question:
Why in world would it NOT be legal for me to
be able to send MY cash to someone else, NO MATTER the reason, so
long as it was not to purchase illegal products, launder dirty money
or knowingly attempt to evade taxation?
It's
alarming that some people may think they are less free
than this, isn't it?
It's more scary to me to think that some people in our free
world actually believe that giving your property to others SHOULD be
illegal. That's really frightening... but the potential legal problem with
online cash gifting is NOT the cash gifting... it's SOLICITING and MARKETING of gifting as a commercial concept for generating cash flow.
Once you send out a post card, or place a Google ad or buy promotion or traffic or leads and drive them to your site, you have committed a commercial activity and any prosecutor would have an easy time convincing a jury that you were using "Cash Gifting" as a money making scheme...
So, is it legal?
I'd highly recommend you speak to your own attorney, or a few of them to get a sense of how cash gifting may be viewed as legal, or illegal by certain Attorneys General. At the end of the day, a person can get themselves in hot water in ANY home based opportunity if enough people file complaints about their conduct.
Then it would be completely up to a court of law to interpret.
Again, for more complete information and advise on the tax
rules regarding gifts, consult with legal and accounting
professionals. This site is NOT written by legal experts or
accounting experts and in no way should this information be taken as
the delivery of legal or accounting advise.
Most Cash Gifting Activities found online these days are NOT
PYRIMIDAL in structure. There is no "fat cat" at the top
benefiting from others. A person starting today can easily generate
more money than some other person who has been in for more than a
year. This is one of the MAIN reasons I had stayed away from Cash
Gifting programs in the past...
There is no pyramid. It's
strictly between YOU and the person who you invite to learn about
your cash gifting activity and sharing club. If they like the
concept, they may agree to give you a cash gift. Direct. Person to
person. No pyramid anywhere.
People just want a simple system that generates
MONEY
Cash gifting
seems to have had mass appeal to just about everyone no matter where you
live in the world in 2008. It was a simpler concept to understand and no fluff
products or services get in the way... no super sales skills needed
or required and it seems to also have had a higher conversion
rate compared to other non gifting, home based
programs. But now in 2010 as cash gifting traffic and appeal is dying due to the low level programs and internal competition in the arena, people are again turning back to viable, sustainable "FROM HOME" online business models that don't come with a stigma or so much bad press and history and questionable legal status
as internet based cash gifting.
