So, What Is "Cash Gifting," Anyway?

By definition, Cash Gifting (also known as Cash Leveraging) is the activity of privately or publicly giving another entity or person an identified sum of cash, strictly as a cash gift, and giving it completely free of any coercion or consideration of any kind.

And that is PRECISELY where many people goof up! Look around the internet and you'll find "Quid-Pro-Quo" dealing and the basic "butchering" of the pure GIFTING concept.

Desperate online "biz-op hustlers" come into cash gifting, assuming they can just do the same type of "dealing" to try to get people to join them and they don't understand, or completely don't care, that doing so completely illegitimizes the concept of "cash gifting" and turns it into basically peddling and soliciting NOTHING... and that's a problem... a problem that can potentially get you into hot water whether you know it or not.

When you see someone "soliciting" gifting or offering special "deals" etc... RUN. That is illegal!

That's exactly why people in other more traditional "home businesses" cry foul and accuse "cash gifters" of being insincere in their cash gifting activities, and I totally agree with them. PRIVATE cash gifting from one consenting adult to another without any expectation of return by the gifter is legal.

As an example, you can meet a stranger on the street right now and CHOOSE to give that person a gift of cash and it would be perfectly legal.

You can GIVE cash to a charity or any other entity or person that you so choose freely and without any consideration and that too is legal.

But hopping on the internet and SOLICITING a gifting "program" and offering "training" and "marketing assistance" and "free leads" etc... CLEARLY lets any person with common sense know that you are taking part in a COMMERCIAL concern and not really "gifting" and that is why the INTERNET and INTERNET "MARKETING" and cash gifting simply can not mix. By definition, it's conflicting.

The true principle of "Gifting" has been seen by some as an effective model for generating and spreading economic prosperity very quickly for many people who engage in it in PRIVATE "BY INVITATION ONLY" GROUPS.

Understanding that the concept of gifting has helped numerous people prosper in all parts of the world, it's also been an endeavor or activity that has been blemished through the years by various "scams" and "get-rich-quick" pyramid and ponzi schemes.

At the fundamental core of Cash Gifting is a basic principle that is too often overlooked and confused with people's cynical sense of greed and lust for money in any regard. However, the true principle is quite simple:

"To help others improve their lifestyles through the simple act of giving freely. In essence, it's all about people using the concept of cash gifting to take back control of their financial independence and helping themselves by helping and giving to others."

Now, that all sounds good to some people, but you just can not separate the gifting from the "soliciting" or "marketing of gifting" as a money making program and that is where you're in grey area or even illegal areas. You just can not be sure until you're arguing inside a court room... and that's a chance you have to take if you get involved in online "solicited" cash gifting.

"Cash Gifting" as a prosperity and wealth building concept was really "born" in the early 1970's when one single, elderly lady took action on a bright idea. Hearing about a family in her church that was about to lose their home due to extreme financial hardship, she decided to take action and do something creative to assist them. She thought "outside of the box" and took firm, decisive action.

Being from the bible belt and having witnessed more than a few traditional "barn raisings", where a whole town would combine to help a family in hardship by giving of their resources and assets, she decided to persuade members of her church to give "Cash Gifts" to help out the family in desperate circumstances.

With the help of Cash Gifting, that family's emergency ended. They had enough money to save their family home. They also received several employment opportunities and other assistance from members of the church, all because of the group decision and model of "selfless giving" without any expectation of return (Cash Gifting).

But With Anything Good, Soon Enough the "Scam Artists" Arrive...

This same concept worked well enough that even the "Greedy Ponzi Schemers" of the 1970's took full advantage of this prosperity building principle. These con artists gave the Federal Trade Commission excellent reason to warn people away from the "Pyramid Ponzi Schemes" that became very popular.

Through the years, there have been numerous personal opinions and thoughts as to the legality, legitimacy and even morality of Cash Gifting as an honest means of creating cash and helping others. This report was NOT written to debate this heated issue. This report is designed to share the information as best we can and my personal opinion based on the facts we've uncovered.

In the 1990's "Cash Gifting" became very popular again as a concept and was aggressively embraced by more church and private groups than ever before in it's entire history. With the advent of the internet, and the massive, free access to instantly communicate all around the world, the popularity of working from home, and of "Cash Gifting" both EXPLODED...

Cash Gifting does NOT involve network marketing, multi-level marketing (MLM), or a business, or any commercial activity. In legitimate and true cash gifting, there are technically no business transactions, investments or securities involved what so ever. It is strictly a private activity between a giver, and a receiver of a cash gift.

There is no company name or business location and there are no managers, owners, officers or shareholders... not even principles. Individuals simply assist each other and help improve the lives of others in a private and "by invitation only" way.

And you can NEVER know for sure if you're dealing with good people. Cash Gifting is often very "quiet" and "privacy" is adhered to and that sometimes allows predators to purposefully hurt people, take their money and leave them holding nothing.

Is The Concept of Cash Gifting Legal and Legitimate?

The bottom line is that YES it can be... Gifting is used in estate planning every day by estate planning firms and attorneys but NOT the way it's used in "cash gifting activities" and with the "wild wild west" of the internet... it has quickly become a sometimes tacky, seedy, pushy niche to take part in. Here is the conflict... IN ANY CASH GIFTING ACTIVITY YOU FIND ONLINE you will be "trained" and advised to "market" your web site. You will be "trained" to "MARKET" with post cards etc...

THAT in itself is a commercial activity. So how does cash gifting stay private and by personal invitation only if you're out there "marketing" gifting? That in effect is SOLICITING. And that can get you in hot water.

The Legality of Gifting Cash was my number one question when I was first learning and researching about Cash Gifting. It's the main question that pops up in the minds of most people as they ponder and consider Cash Gifting as a viable concept for improving their financial situations, after all, I have absolutely no interest in getting involved in any illegal type of endeavors, and I'm sure you don't either, so here is the information I found out:

In studying this activity it's important to keep in mind that there is no textbook or manual available that explains exactly what is legal in our society... we only have legal codes that tell us what is NOT legal.

If you do your own study online or offline, you're going to see that there is really nothing specifically saying that cash gifting itself is illegal. Most often, it's people expressing their personal opinions, and not facts. Usually the people who are the "loudest" in their personal opinions about cash gifting are also people who are involved in a competing money making model, such as MLM distributors who see gifting as a competitor that endangers their sales of magic fruit juices or miracle potions and lotions, so you really have to learn to dig a bit deeper and get past people's hidden agendas and biases.

In the United States we have the Constitution (including the Preamble) and the Bill of Rights to protect our private, and free citizen's rights to earn, own and give away property and any assets, including cash as long as it's done according to the laws and codes of the nation. The U.S. gifting regulations are found in the Internal Revenue Service's Tax Code, Title 26, Sections 2501-2504 and 2511.

Currently, as I write this special report, the law states that an individual or entity can give a cash gift to another individual of up to $12,000 each per calendar year without any tax liability to either the giver or receiver of the gift, because the tax on the gift has supposedly already been paid.

That does not mean that $12,000 is the legal gifting limit. You can give more, but then would be liable for the tax on any gifts above the limit allowed under the current or existing code. For details on these rules you should consult a tax professional who is licensed to give advice on the topic.

However, prudence should rule... and even though gifts don't have to be included in the gross income of the recipient's tax return, it's probably a good idea to pay taxes on any and all cash gifts you receive from anyone not related to you. At the bare minimum, people should be declaring all gifts received and keep accurate records and file all Gift Statements received and forward to your tax preparer or accountant.

That is just good common sense. Realize that this is a topic you should take up with competent tax counsel and it is NOT the intention in this report to give any tax advice whatsoever.

And remember, that at the end of the day, if you're using blatant hype or desperation sales pitches, you'll attract the wrong people who will NOT understand the reality and leverage of cash gifting and WILL lodge complaints against you; and if someone DOES complain that they believe they have been scammed in some way... there can be HUGE negative issues and repercussions.

Again, if you're out there just willy-nilly "marketing" like crazy to skeptics, or the general masses and you're conducting yourself in questionable ways, there will always be a growing chance that you'll attract the wrong person and they will believe they are some kind of victim and get you investigated.

IS THAT WORTH TINY $100 "Gifts?"

The bottomline of cash gifting on the internet is this:

You WILL be soliciting. So that means there will ALWAYS be a possible legal issue with gifting. It's only a matter of IF or WHEN someone will file a complaint against you and whether the States Attorney General or any other Prosecutor will want to come after you and make you defend yourself and the legality of your actions in a court of law.

At that point it really doesn't matter what YOU think is right or wrong, legal or illegal because at that point EVERYTHING will be up to the 12 people in the jury box and it becomes a "sales presentation" for the competing attorneys to try and persuade the jury and "win" so just keep that in mind if you're getting into an INTERNET based cash gifting "system."

With so many other VIABLE and TOTALLY Legitimate models for making large sums of money from home using the internet, is it really WORTH IT to get involved with Online Cash Gifting?

Considering the fact also that Cash Gifting has been losing market share considerably online since the beginning of 2009 as most marketers have given up and gone back to promoting legitimate home businesses on the internet due to the stigma and potential legal issues with internet based gifting programs and the fact that it's just not converting as well anymore on the internet, maybe you should take a look also at alternative ways to generate significant income from home using the leverage of the internet.

Either that or learn about Private "By Invitation Only" OFFLINE programs and groups.

Cash Gifting. Pyramid Scheme? Or NOT A Pyramid Scheme?

In most cash gifting programs that use a direct model there is no pyramid at all present. By definition, it can not be a pyramid, since the cash gifts go from one individual to another. Each person invites another person to review the cash gifting structure. If that invited person finds the concept agreeable and decides to gift the host, the gift goes directly from the giver, to the receiver with the proper Gifting Statement documentation.

Nobody else is involved in the actual cash gift. The problem lies with the fact that people in cash gifting activities online are trained to SOLICIT and MARKET and THAT can be a big potential problem down the road. The fact that the private membership uses individual marketing systems such as replicated websites, "marketing training" etc... is a potential problem as it clearly shows that gifting activities are being used as commercial and marketing "systems."

There are no sales requirements in cash gifting. There are no products that need to be sold and there are no rankings, or positions that are sold. There is never a need to send your gift to an "admin" as in other more traditional Multi-Level Marketing programs and illegal pyramid schemes.

The gifts should go to a private individual.

In the classic ponzi-style money game, only the few at the top of the model get the vast majority of the profits, as those new member's money is used to pay the "big gurus" at the very top of a massive pyramid. The people at the bottom seldom ever make money. Illegal ponzi and pyramidal scams should not however, be confused with legal Multi-Level Marketing, Network Marketing and affiliate marketing structures.

Most people are looking for ways to generate cash flow from home using the internet are NOT only interested in cash gifting. There are other fast converting and legitimate ways to generate income online than gifting and people are finding that out by the millions.

They simply are looking for leveraged ways that work to generate cash flow. Cash Gifting programs continue to provide people with a simple way to generate cash flow but it's not the best model to use on the internet as the internet itself is what kills most cash gifting activities in little over 2-3 months, and it's only a SMALL niche compared to the wide open market space for real internet businesses. There will always be a HUGE segment of the "make money from home" arena that will always shy away and shun people associated with online based cash gifting.

It may be a smarter business decision NOT to pigeon hole yourself in such a tough and tiny niche to compete with millionaire Cash Gifting Solicitors online who mail out TENS of THOUSANDS of dollars in solicitation post card campaigns and Pay Per Click marketing and have a thorough lock on this tiny niche online.


Cash Gifting On The Internet Potentially puts you in a dangerous situation. Normal, Everyday People from ALL walks of life are choosing other ways to earn money from home and NOT be under the microscope or stigma of online based cash gifting.

Aren't all Cash Gifting Systems Basically The Same As Other Home-Based "Businesses"?

Cash Gifting was attracting many people lately because it was LUCRATIVE and gifting levels were set HIGH enough to be attractive. Cash Gifting had been one of the highest converting activities above and beyond all other more traditional "biz ops" because it seemed more simple and more lucrative. But now with the creation of "POCKET CHANGE" gifting levels all the way below $50, most professional marketers know that it's not returning enough to cover expenses and only attracting low level people who do not really take this seriously...

Overview: Spirit of Wealth is a cash gifting program that was founded by a team of cash gifters from another program (NOSS) in order to have more liberty in their marketing tactics and to take advantage of some internet marketing leverage that was not allowed at NOSS.

SOW consists of a THREE Tier participation structure of $500, $1,500 and $3,500. Adinistration and tracking is provided by a professional 3rd party organization and software system which costs members $120 yearly. Members use internet marketing systems, audios and videos as part of their leverage tools.

Strengths: The $500 entry level is key to attracting a large group of people. The level keeps this program accessible to nearly everyone who is serious. Most websites use full online presentation tools including videos/audios so the presenting and explaining is consistent and highly automated on the front end. Gifts are received in cash by professional overnight courier service. As long as people put in solid effort and follow through, this program has shown to convert well.

Weaknesses: Heavy follow up phone work should be expected. Internet marketing and traffic generation can be learned if you are on a good team with support and training, but this program will demand consistent personal follow up. Most follow up will be done by phone so human relations and communications skills are required in order to succeed. Most people HATE to think they will have to convince or do much explaining to strangers on the phone and other people simply fail to make a good impression with people on the phone. This may be a huge weakness in the program for many people.


The main weakness that we saw with this program is that invitees never know whether they are being invited by a team that has sufficient training and marketing support platforms to really be able to help new people, or not. You won't know unless you find out before you join.

BOTTOM LINE: Realistically, knowing the skills and desires of the majority of people coming into this type of activity, I believe this program may NOT be as automated as far as the grunt communication work for most people. A few people with great confidence and communication skills can come in and out-perform easily, but in the face of competition with other systems that are much more automated, even those leaders seem to gravitate away. The fact that "success" in this activity is based on "marketing skills" and is online based crosses the line between true cash gifting activities and online marketing. We would not recommend this online system.

Overview: This system is very similar to SOW. Same levels of $500, $1,500 and $3500 and also a 1UP structure which is all good. The system has been around over 7 years. This cash gifting program also attracts people that find the levels accessible. Automated tracking systems are in place to track all traffic, referrals and gifts for members. The cost members pay to maintain the tracking system is $100 yearly.


Strengths: The levels make it very accessible to the vast majority of serious people. Professional conference calls assist in the explanation of the system on a weekly basis. Cash Gifts are received by professional overnight courier.

Weaknesses: Another online based gifting group dependent on Internet Marketing activities to make it successful. Red Flag.

BOTTOM LINE: Avoid it.

Ecosov 800 ("Q" The Cash Gifting Guy)

Overview: "Q", a mysterious, underground personality from St. Lucia in the Caribbean has been the leader of this Cash Gifting activity for about 9 years now. The levels here used to start at $1,000 but now there are only a couple very high levels, $6,600 and $18,500.

This program also uses a 1UP structure and proper documentation. Professional overnight courier service handles the shipping of gifts between members. "Q" is a personality. His marketing and follow up communications are edgy and it's very apparent that he is very well school in the art and science of direct response marketing and copywriting.

He comes off as a "in-your-face", and often "arrogant" personality style that is offensive at times. The character is one where most people either dismiss him right away, while others follow him blindly.

There is no replicated website system with this program. Everyone sends invited guests directly to Q's website and the invitee must give Q the ID number of the member who invited him. Supposedly, if people can't remember or don't have the ID number, they can't join. However, there is really no way to confirm this for sure.


Without tracking of guests, one simply can not confirm how effective this is. You're basically flying blind.


Strengths: As long as you send guests into "Q's" website, this system is fully automated. Q handles everything for everyone.

Weaknesses: Q speaks openly of "marketing" and "advertising" to send people to his site so he can "close your enrollments" which crosses the line again into SOLICITING. There is no way to know if your guests are being tracked appropriately. There simply is no way to really track and gauge how this system is converting and one person is supposedly handling the marketing for an entire program that has been around for over 9 years.

People we consulted with have reported that at the beginning, conversions were relatively at the same level as with other top tier opportunities. As time went on however, conversions slowed dramatically on the same volume and quality of traffic being sent in.

The high level of entry automatically puts this system out of the reach of the vast majority of the people at $6,600. The other major weakness in this system is that it's designed where you must give up to "Q" EVERY 5th cash gift you generate. At a minimum of $6,600 every five cash gifts is an enormous amount of money to give up to admin.

BOTTOM LINE: Very risky and to be avoided.

TOCS (The Overnight Cash System)


Overview: The Overnight Cash System or TOCS, as most refer to it is a Cash Gifting activity that has been around almost 4 years. TOCS has seen incredible growth in the last couple years but really grew exponentially this year in 2008 with the release of it's fully automated internet based marketing system which includes a professional group of Team Leaders who follow up and complete enrollments for all members at no additional cost. TOCS consists of 6 levels at $250, $500, $1000, $2500, $5000 and $10,000 gifting tiers.

 

Strengths: None. Since this system uses so much hype and clearly presents itself as an online marketing system for making money, it obviously crosses the line and ceases to be a true cash gifting activity. It is not "private" by any means.
